Warranty Information
Products sold as NEW are warranted by the manufacturer. You are entitled
to the manufacturer's limited express warranty, if any that accompanies
the product. Starfish Networks Inc makes no additional or independent
warranty. All warranty claims must be made through the product manufacturer,
not through Travel Computer Repair. Warranty service for Apple products
can be provided by any Apple Authorized Service Provider (which Starfish
Networks Inc is not). All products sold as DEMO carry the remainder
of the manufacturer's warranty.
All products sold as REFURBISHED are sold "AS IS" unless
otherwise stated. If a Starfish Networks Inc warranty is stated, Starfish
Networks Inc will repair or replace, at our option, the REFURBISHED
product containing manufacturing defects so long as the product is
returned in its original shipping materials to Starfish Networks Inc
within the warranty period. This warranty is made only to the purchaser
whose name appears on the original invoice, is non-transferable, and
is void if resold. Service by a non-approved technician voids any
Starfish Networks Inc warranty. If Starfish Networks Inc accepts product
for repair of manufacturing defect, but discovers that the problems
are unrelated to manufacturing defects, or caused through service
by a non-approved technician, buyer agrees to pay Starfish Networks
Inc $85.00 per hour for such repairs. No merchandise will
be accepted for repair or replacement without prior Return Merchandise
Authorization (RMA). To obtain an RMA number, please call 954-235-1561.
Starfish Networks Inc disclaims all express or implied warranties
regarding the merchantability and fitness of the products you have
purchased for any particular purpose. Starfish Networks Inc makes
no warranties that the products you have purchased are compatible
with any particular software or non-Starfish Networks Inc equipment.
Starfish Networks Inc is not responsible for any damage, problems,
or data loss resulting from software, hardware failure, or non-Starfish
Networks Inc equipment placed by Customer on Starfish Networks Inc
product. Installation or service by a non-approved technician voids
any and all warranties, expressed or implied. Starfish Networks Inc
shall under no circumstances be liable for special, incidental, or
consequential damages including loss of profit, even if it has been
advised of the possibility of such damages; the maximum liability
for all direct damages, if any, arising out of any action shall be
limited to an amount not to exceed the purchase price of the product.
Terms, Conditions & Trademarks
Returns
Your overall satisfaction with our company and staff is our number
one goal. We eat, sleep and breathe customer service and we constantly
work to improve our products and services. If you do find yourself
with an item you wish to return, please review the following information.
Starfish Networks Inc must authorize all returns within 30 days of
the invoice date. Some items can be returned only for store credit.
Please see individual product pages for return conditions. We can
only accept returns in the same condition and packaging in which they
were shipped (e.g., New Factory Sealed items must still be sealed).
A 15% restocking fee will be applied to returns made within 30 days
of purchase.
Defective Returns: In the unlikely event that you
receive a "dead on arrival" defective product, please call
our Technical Support department immediately at 954-235-1561. We will
attempt to perform a miracle over the telephone and revive the item
in question. We're pretty good at this, but sometimes an item needs
to be returned to us. In the case of DOA items, we will issue a "Call
Tag" to cover the cost of return shipping. You must call us within
3 days of receiving a DOA product in order for us to pay for return
shipping.
Prior to shipping your return, please call 954-235-1561 to get a Return
Merchandise Authorization (RMA) number. Items must be returned within
10 days after receiving your RMA. Any item received without an RMA
will be returned to you at your expense. Please write your RMA number
on the outside of the package, and ship to:

Starfish Networks Inc does not pay return shipping (except in cases
of DOA products; see above) or international customs/duties. If a
Starfish Networks Inc account is used to return an item, the returning
party's credit card will be billed for the shipping and handling charges.
Products that are purchased at a discounted rate due to the EXCHANGE
of a non-functional core are sold with the condition that Starfish
Networks Inc will receive, within 10 business days, the non-functional
part or product in repairable condition. All return parts must be
accompanied by an Starfish Networks Inc Exchange Part Return Form
in order for your account to be credited for the exchange. You will
receive an exchange form and instructions with your order.
Errors and Omissions
Starfish Networks Inc makes every effort to ensure the accuracy of
the information published in our advertisements and on our web site.
However, the documents and graphics published on this site may contain
technical inaccuracies or typographical errors. Starfish Networks
Inc makes no representations about the suitability of the information
and graphics presented on this site. All such documents and graphics
are provided "as is" without warranty of any kind.
If an error is made and a product is listed at an incorrect price,
Starfish Networks Inc shall maintain the right to refuse or cancel
any orders placed at the incorrect price. Products and packaging depicted
may differ from stock available time of shipment. We reserve the right
to substitute equivalent items.
Note: We do not guarantee Starfish Networks Inc prices
listed on other Web sites or price engines.
Starfish Networks Inc Standard Terms of Sale
All sales are subject to the following terms and conditions:
1. Customer Acknowledgment.
Customer acknowledges agreement with these Terms of Sale by the placement
of an order to purchase a Product from Starfish Networks Inc.
2. All Sales Made In Florida.
All sales shall be deemed made in the State of Florida, USA, regardless
of the location of the Customer.
The Customer agrees that any dispute with Starfish Networks Inc arising
out of the Customer's purchase from Starfish Networks Inc shall be
brought by the Customer exclusively in the state or federal courts
situated in the State of Florida; and the Customer hereby agrees that
such venue is appropriate and that Starfish Networks Inc 's agreement
to sell and deliver products to the Customer is dependent on this
provision.
3. Purchase Price.
(a) Prices are listed in Starfish Networks Inc 's advertisements and
web site, and are subject to change without notice. Prices for certain
governmental, corporate, and institutional customers may be set forth
in a bid or other written agreement between the parties.
(b) Payment is due before shipment, unless credit terms have been
arranged in advance with Starfish Networks Inc ' Credit Department.
In such case, payment terms shall be as set forth in the credit agreement.
(c) Starfish Networks Inc collects sales and use taxes for sales shipped
to the State of Florida. Starfish Networks Inc shall not be liable
for handling or customs charges for shipments outside the United States.
4. Shipping Terms.
Starfish Networks Inc will arrange payment for shipping with the carrier,
but such costs are the responsibility of Customer. For any products
sold that are damaged, lost, or stolen by carrier in transit to Customer,
an insurance claim must be submitted to the carrier, not to Starfish
Networks Inc. Starfish Networks Inc is not responsible or liable for
loss or resulting damage due to carrier's negligence or theft. Delivery
times are estimates only and Starfish Networks Inc shall not be liable
for delays. Orders that are returned or refused will be charged a
15-30% restocking fee.
5. Vendor License Agreements.
Customer agrees to abide by all license provisions or end user agreement
imposed by the manufacturer or publisher.
6. International.
Products sold by Starfish Networks Inc, including equipment and software,
may be exported from the United States only in accordance with the
Export Administration Regulations. Diversion contrary to United States
law is prohibited. Customer warrants and represents that it is eligible
to receive Products under United States law and agrees to abide by
any export or re-export restrictions imposed by the manufacturer or
publisher.
7. LIMITED MANUFACTURER'S WARRANTY.
(a) Starfish Networks Inc warrants that it has good title to the hardware
Products it sells, and that it has proper authority to license the
software Products it distributes.
(b) Starfish Networks Inc does not warrant the performance or integrity
of any Product, but merely passes through to the Customer whatever
end-user warranty the manufacturers or software publishers provide
with their respective Products.
(c) YEAR 2000 DISCLAIMER. Starfish Networks Inc ENCOURAGES ITS SUPPLIERS
TO MAKE THEIR PRODUCTS AND SERVICES YEAR 2000 COMPLIANT. HOWEVER,
Starfish Networks Inc CANNOT AND DOES NOT REPRESENT OR WARRANT THAT
ANY PRODUCT IT ADVERTISES OR SELLS IS FREE FROM DATE RELATED ERRORS
RESULTING FROM THE TURN OF THE CENTURY (THE YEAR 2000). ANY INFORMATION
PROVIDED ON PRODUCTS HAS BEEN FURNISHED BY THE MANUFACTURER AND IS
PROVIDED TO END USERS "AS IS."
STATEMENTS MADE TO YOU IN THE COURSE OF ANY PRIOR, CURRENT, OR FUTURE
SALE ARE SUBJECT TO THE YEAR 2000 INFORMATION AND READINESS DISCLOSURE
ACT, (___U.S. C.___) (P.L. 105-271). IN THE CASE OF A DISPUTE, THIS
ACT MAY REDUCE YOUR LEGAL RIGHTS REGARDING THE USE OF ANY SUCH STATEMENTS,
UNLESS OTHERWISE SPECIFIED BY YOUR CONTRACT OR TARIFF.
(d) Starfish Networks Inc DISCLAIMS ALL OTHER WARRANTIES, EXPRESS
OR IMPLIED BY LAW, INCLUDING MERCHANTABILITY AND USE FOR A PARTICULAR
PURPOSE.
8. LIMITATION OF LIABILITY.
IN NO EVENT SHALL Starfish Networks Inc BE LIABLE FOR SPECIAL, INCIDENTAL,
OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT
OR OPPORTUNITY. CUSTOMER'S SOLE AND EXCLUSIVE REMEDY IS STATED IN
THE MANUFACTURER'S OR PUBLISHER'S END USER WARRANTY ACCOMPANYING THE
PRODUCT. IN NO EVENT SHALL STARFISH NETWORKS INC. LIABILITY EXCEED
THE REPAIR, REPLACEMENT OR COST OF THE SPECIFIC PRODUCT PURCHASED
FROM MACWORKS. THE PARTIES AGREE THAT THE LIMITATIONS IN THIS SECTION
ARE INTEGRAL TO THIS ORDER. SOME STATES MAY NOT RECOGNIZE A DISCLAIMER
OR LIMITATION OF WARRANTIES AND/OR LIMITATION OF LIABILITY SO THE
ABOVE DISCLAIMERS MAY NOT APPLY. CUSTOMER MAY ALSO HAVE DIFFERENT
AND/OR ADDITIONAL RIGHTS AND REMEDIES THAT VARY FROM STATE TO STATE.
9. Returns.
Returns of Products are subject to Starfish Networks Inc ' current
return policies, which are set forth on this web site, subject to
any additional or lesser return rights adopted by the manufacturer
or publisher.
10. Exclusive Agreement.
These Terms of Sale represent the complete and final agreement between
the Customer and Starfish Networks Inc for the matters set forth herein,
and shall be supplemented only by the prices, quantity, and descriptions
set forth in Starfish Networks Inc 's invoice for the relevant sale.
Terms contained in Customers' purchase orders, offers to buy, terms
and conditions, and the like shall have no effect.
11. General.
(a) These Terms of Sale and any transactions made under them shall
be interpreted by and be subject to the laws of the State of Florida.
Should any dispute arise regarding this agreement, Customer consents
to jurisdiction in the State of Florida and agrees that venue is proper
in the County of Broward. Customer agrees that the place of performance
of this agreement is in the County of Broward, State of Florida. Further,
the prevailing party in any such dispute shall be entitled to costs
including attorney's fees.
(b) In the event any section or portion of a section of these Terms
of Sale are deemed unlawful or unenforceable, that section or portion
of a section shall be stricken from the Terms of Sale, and the remaining
terms shall continue in full force and effect.
(c) Starfish Networks Inc shall not be responsible for damages or
delays resulting from Acts of God, and from other actions, both governmental
and otherwise, including but not limited to war, riot, seizure, and
embargo.
(d) These Terms of Sale may be modified from time to time by Starfish
Networks Inc without notice, and are current as of the date of the
web site. Please refer to the current web site.
